RETURN AND WARRANTY POLICY

  1. INTRODUCTION

This Return and Warranty Policy forms part of the Terms and Conditions governing your use of the Spare24 online platform operated by Reach Folks (Pty) Ltd (“Spare24”, “we”, “us”, or “our”).

Spare24 is committed to ensuring that our customers are satisfied with their purchases and that all transactions comply with South African consumer protection laws.

This policy outlines the conditions under which tyres purchased from Spare24 may be returned, exchanged, or warrantied.

  1. LEGAL BASIS

This policy is governed by:

  • Consumer Protection Act, 2008 (Act No. 68 of 2008) (“CPA”)
  • Electronic Communications and Transactions Act, 2002 (Act No. 25 of 2002) (“ECTA”)
  • Protection of Personal Information Act, 2013 (Act No. 4 of 2013) (“POPIA”)

Under these laws:

  • You have the right to return defective or incorrect goods within a reasonable time.
  • You are entitled to a 7-day cooling-off period for online purchases made through our website under Section 44 of the ECTA.
  1. ELIGIBILITY FOR RETURNS

You may return a tyre purchased from Spare24 only if one or more of the following conditions apply:

3.1 Cooling-Off Period (ECTA)

  • You may cancel an online purchase within 7 (seven) days of receiving the product.
  • The product must be unused, unfitted, and in its original packaging.
  • The cost of return shipping will be borne by the customer unless the return is due to an error on our part (e.g., wrong item shipped).

3.2 Defective or Damaged Goods (CPA)

  • If the tyre is defective, damaged, or not as described, you may return it within 6 (six) months of delivery.
  • We will, at our discretion, inspect the tyre and offer one of the following remedies:
    • Repair (if feasible),
    • Replacement with an identical or similar product, or
    • Full refund.

3.3 Incorrect Product Supplied

If you receive a tyre different from what you ordered:

  • Notify us within 7 (seven) days of delivery.
  • Do not fit or use the tyre.
  • We will arrange for collection and replacement at no additional cost.
  1. CONDITIONS FOR RETURN

To qualify for a return, the following conditions must be met:

  1. The tyre must not have been used, fitted, or driven on.
  2. The tyre must be in its original, undamaged packaging.
  3. The tyre must be returned with proof of purchase (invoice or order confirmation).
  4. Returns must be initiated by contacting our support team at hello@spare24.co.za within the applicable return period.
  5. The customer is responsible for ensuring the tyre is properly packaged for transport.
  6. The terms of this policy can be changed unilaterally at any time without your consent by Spare24

Spare24 reserves the right to inspect the returned product before approving any refund or replacement.

  1. NON-RETURNABLE ITEMS

We cannot accept returns under the following circumstances:

  • Tyres that have been fitted, mounted, inflated, or used on a vehicle.
  • Tyres showing signs of wear, tampering, or modification.
  • Tyres damaged due to improper storage, incorrect fitment, or misuse.
  • Custom-ordered, special-import, or clearance tyres (unless defective).
  1. WARRANTY POLICY

6.1 General Warranty

All tyres sold by Spare24 are warranted against manufacturing defects for a period of 6 (six) months from the date of delivery, in accordance with the Consumer Protection Act (CPA).

This warranty covers defects arising from the manufacturing process only and not from installation, usage, or external damage.

6.2 Fitment Conditions

Because Spare24 does not provide fitment services, warranty coverage is only valid under the following conditions:

  1. The tyre has not been used, driven, or fitted; or
  2. The tyre was fitted and balanced by a recognized and qualified fitment centre that follows manufacturer specifications.

The customer must retain the fitment invoice from a recognized tyre fitment centre as proof.

Failure to comply with these fitment conditions voids the warranty.

6.3 Warranty Exclusions

The following are not covered under this warranty:

  • Damage resulting from improper fitment, balancing, or alignment.
  • Damage due to punctures, cuts, impacts, or road hazards.
  • Damage caused by incorrect inflation pressure.
  • Damage from racing, overloading, or off-road misuse.
  • Natural wear and tear due to normal use.
  • Damage caused by chemical contamination or fire.

6.4 Warranty Claims Process

If you believe your tyre is defective and wish to submit a warranty claim:

  1. Contact Spare24 at [hello@spare24.co.za with:
    • Proof of purchase
    • Photos of the tyre and serial markings
    • Fitment invoice from a recognized centre (if applicable)
  2. Spare24 may arrange for an inspection by a qualified tyre assessor or manufacturer representative.
  3. If a manufacturing defect is confirmed:
    • A replacement tyre or refund (partial or full) will be provided.
    • If the tyre is found not defective, the claim will be declined, and inspection/shipping costs may be charged to the customer.
  1. REFUND PROCESS
  • Refunds will be processed via the original payment method within 10 (ten) business days after approval.
  • Where applicable, delivery or collection costs may be deducted from the refund.
  • Refunds will not be issued for tyres found to have been used, fitted, or damaged through user fault.
  1. RETURN SHIPPING
  • For defective or incorrect items: Spare24 will cover the cost of collection and return shipping.
  • For cancellations under the cooling-off period: the customer bears the return shipping cost.

We recommend using a trackable courier service to ensure safe delivery of returned tyres.

  1. LIABILITY LIMITATION

To the extent permitted by South African law:

  • Spare24’s liability for defective products is limited to replacement or refund of the purchase price.
  • Spare24 is not liable for any consequential, indirect, or incidental damages resulting from tyre use, installation, or transport.
  1. GOVERNING LAW

This Return and Warranty Policy is governed by the laws of the Republic of South Africa, and any disputes shall fall under the jurisdiction of the High Court of South Africa or another competent court.
